Senate Bill 260 does the following:
*First, it authorizes a county sheriff, at the discretion of the board
of county commissioners, to take custody of persons being detained for
deportation who are charged with civil violations of federal immigration
law.
AG Opinion No. 2007-018 stated that a county sheriff's duty to
preserve the public peace includes the concomitant authority to
arrest and detain aliens who violate a criminal provision of
federal immigration law. Such provisions may include the failure to
carry a certificate of alien registration or alien registration
receipt card or when an alien has entered or attempted to enter the U.S.
at any time or place other than as designated by immigration officials.
*Additionally, Senate Bill 260 amends the general powers and duties of a
county sheriff by giving a sheriff the authority to render assistance to
federal immigration officials in matters related to the investigation,
apprehension, and detection of aliens who violate criminal or civil
provisions of federal immigration law.
*Finally, it the bill clarifies that state and local employees, when
rendering assistance to federal immigration officials, may assist in the
investigation, apprehension, and detection of aliens who violate
criminal or civil provisions of federal immigration law in compliance
with lawful requests made under the USA Patriot Act.
